Terms of Service

01Acceptance & Eligibility

By reserving, purchasing, accessing, or using the Fammai device and its associated services, you agree to these Terms. You must be at least 18 years old (or the age of majority in your jurisdiction) to reserve, purchase, or operate a Fammai device. If you are using Fammai on behalf of a household, you represent that you are authorized to install and configure cameras for that household.

02Description of Service

Fammai is a pre-configured hardware device — a desktop AI hub — that connects to ONVIF/RTSP-compatible cameras you already own or purchase separately. The device runs on-board vision-language models locally to deliver: (a) real-time safety alerts (fire, fall, leak, intruder, door-left-open and similar categories), (b) twice-daily plain-English Daily Briefs about your home, and (c) Ask-Fammai natural-language search across the on-device index of recent activity. Fammai does not include a built-in camera. Optional cloud routing using your own third-party API key may be enabled at your discretion for queries you choose to route.

03Camera & Network Responsibilities

You are responsible for: providing the cameras Fammai connects to, complying with the recording laws of your jurisdiction (including notice and consent requirements where applicable), installing cameras only in spaces you have a right to monitor, and configuring privacy zones for sensitive rooms. You are responsible for the security of your local network and for any credentials stored on the device for connected services.

04License Grant & Restrictions

We grant you a limited, non-exclusive, non-transferable license to use the Fammai firmware, on-device AI software, and Daily Brief features on your purchased device. You may not:

• Reverse engineer, decompile, or disassemble the firmware or software (except as permitted by law)
• Modify the firmware in ways that circumvent security mechanisms
• Redistribute, sublicense, or resell the software separately from the hardware
• Use the device to operate a commercial AI inference service for unaffiliated third parties
• Use Fammai to monitor people who have not consented to being recorded where consent is required by law

Open-source components included on the device are governed by their respective license terms, available on the Open Firmware page when published.

05AI Service Disclaimers

Fammai's safety alerts are intended as a secondary signal layer. We publish alert-accuracy metrics from the pilot batch and continue to track accuracy in production, but no AI system achieves perfect detection or zero false positives. You are responsible for setting alert thresholds appropriate for your home and risk tolerance.

We do not guarantee the accuracy, reliability, or availability of any AI model — local or cloud-routed. On-device model capabilities may change as the firmware updates or third-party providers update their services.

06User Content & Data

You retain full ownership of all video, audio, recordings, AI output, and configurations stored on your Fammai device. We do not access, collect, or claim any rights to your on-device data.

When you voluntarily submit feedback, feature requests, or bug reports to us, you grant us a non-exclusive, royalty-free license to use that feedback for product improvement.

07Prohibited Conduct

You agree not to use Fammai to:

• Violate any applicable law or regulation, including recording, wiretap, and privacy laws
• Monitor people in spaces where they have a reasonable expectation of privacy without lawful basis
• Stalk, harass, or surveil any person
• Identify individuals via facial recognition or biometric matching (Fammai does not provide these capabilities, by permanent commitment, and we prohibit attempts to add them via firmware modification)
• Attempt to gain unauthorized access to systems, networks, or accounts
• Interfere with or disrupt Fammai's update or telemetry services

08Third-Party Cameras & Services

Fammai connects to third-party cameras and services you authorize. These products are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, recording behavior, or security of third-party cameras. You are responsible for selecting cameras compatible with Fammai's stated standards (ONVIF, RTSP, and supported variants) and for complying with their terms.

If you enable optional cloud routing with your own API key, the selected provider's terms (Anthropic, OpenAI, Google, or another) apply to that traffic. Charges from that provider are between you and the provider; Fammai is not in the billing loop.

09Intellectual Property

The Fammai name, brand, hardware design, firmware (excluding open-source components), and documentation are the intellectual property of Prizmox Inc. These Terms do not grant you any rights to our trademarks, trade dress, or proprietary technology beyond the limited license in Section 4.

10Pricing & Billing

Hardware: One-time purchase at the listed price. Pre-launch reservations lock in a discount of $50 off the launch price. No recurring subscription fees are required for the device's core AI features, on-device model updates, or Daily Brief.

Optional cloud routing: If you enable cloud routing using your own API key, you are responsible for the cost of the selected provider's API charges, billed by that provider directly. We may, in the future, offer an optional managed routing service with its own clearly disclosed pricing; any such service will be opt-in.

11Warranty Disclaimer

The Fammai software, firmware, on-device models, and AI features are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Hardware warranty is governed separately by the Limited Hardware Warranty below.

12Limited Hardware Warranty

Prizmox Inc. warrants the Fammai hardware device against manufacturing defects for one (1) year from the date of delivery. Extended warranty plans may be available at purchase.

Covered: Defects in materials and workmanship under normal use.

Not covered:

• Physical damage (drops, liquid, crushing, impact)
• Damage from unauthorized modification, jailbreaking, or firmware tampering
• Normal wear and tear
• Damage from power surges or improper power supply
• Cosmetic damage that does not affect functionality
• Environmental damage (excessive heat, humidity, dust, etc.)

Remedy: At our discretion, we will repair or replace the defective unit. Contact warranty@fammai.com to initiate a warranty claim.

13Reservations, Returns & Refunds

Reservation Terms:

• A reservation is a pre-launch commitment, not a guarantee of delivery. Product availability, specifications, pricing (other than the locked reservation price), and ship dates are subject to change.
• Your right to cancel: You may cancel your reservation at any time before the device ships and receive a full refund, no questions asked. Contact hello@fammai.com or use the cancellation link in your reservation confirmation email.
• Our right to cancel: Prizmox Inc. reserves the right to cancel any reservation at any time before shipment — including for reasons of product availability, production delays, regulatory requirements, or business decisions. If we cancel your reservation, you will receive a full refund of the amount paid within 7 business days.
• No interest or compensation: Refunds for cancelled reservations are limited to the amount paid. No interest, damages, or additional compensation will be owed by either party upon cancellation.
• Delay notifications: In compliance with the FTC Mail/Internet Order Rule, if we are unable to ship by the stated date, we will notify you of the revised ship date and your right to cancel for a full refund.

Post-Delivery Returns:

30-day money-back guarantee. If Fammai isn't right for your home in the first 30 days after delivery, return the device for a full refund. The device must be in original condition with all included accessories. We cover return shipping within the continental United States.

EU/UK customers: You have a statutory 14-day right of withdrawal from the date of delivery, in addition to our 30-day guarantee.

Refund method: All refunds are issued to the original payment method within 7–10 business days of cancellation (reservations) or receipt of returned device (post-delivery returns).

14Limitation of Liability

To the maximum extent permitted by law, Prizmox Inc.'s total liability for any claim arising from or related to the device or services is limited to the amount you paid for the device.

We are not liable for any indirect, incidental, special, consequential, or punitive damages — including property damage, personal injury (except to the extent caused by our gross negligence and not excludable by law), missed alerts, false alarms, or loss of recorded footage — even if we were advised of the possibility.

This limitation applies to claims based on warranty, contract, tort, or any other legal theory. Nothing in these Terms limits liability that cannot be limited under applicable law.

15Indemnification

You agree to indemnify and hold harmless Prizmox Inc. from any claims, damages, or expenses arising from your use of the device, your violation of these Terms, or your violation of any third-party rights — including the recording, wiretap, and privacy laws of your jurisdiction.

16Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any dispute arising from these Terms will be resolved through binding arbitration administered by JAMS, conducted individually (not as a class action). You may opt out of arbitration by notifying us in writing within 30 days of your purchase.

Class action waiver: You agree to resolve disputes individually and waive any right to participate in class-action lawsuits or class-wide arbitration.

17Export Controls

The Fammai device and software may be subject to U.S. export control laws (EAR). You agree not to export, re-export, or transfer the device to any country, entity, or person prohibited by applicable export laws.

18Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email and posted on our website at least 30 days before taking effect. Continued use of the device or services after changes take effect constitutes acceptance.
